Thank you for your interest in the SFCTA Clean Transportation Scavenger Hunt. We hope that you find this fun and entertaining, and we want to make sure that you (and your parents, if you are under the age of 18) understand a few important terms. Please read the following Terms of Participation and check the appropriate boxes below, and you can learn more about how to participate in the Scavenger Hunt.
1. Participate Safely. First, and most importantly, please be safe while you participate in the Scavenger Hunt! Each of the required photos can be taken from a sidewalk, so there’s absolutely no need to do anything dangerous or risky, like standing in the street to take a photo. Please be aware of your surroundings at all time while participating in the Scavenger Hunt, both when you are taking a photo and when you are posting any photo to social media. If you are a parent of a minor participant, please ensure that your child participates safely. Safety is up to you.
2. Waiver of Liability. Since each participant is in full control of their activities while participating in the Scavenger Hunt, you acknowledge that SFCTA is not responsible for your actions, or your child’s actions, during such participation. Accordingly, TO THE FULLEST EXTENT PERMITTED UNDER LAW, BY PARTICIPATING IN THE SCAVENGER HUNT OR ALLOWING YOUR MINOR CHILD OR GUARDIAN TO PARTICIPATE, YOU HEREBY WAIVE AND RELEASE ALL CLAIMS AND LIABILITIES (WHETHER ON BEHALF OF A MINOR CHILD OR AN ADULT PARTICIPANT) AGAINST SFCTA (INCLUDING ITS STAFF, EMPLOYEES, AND AGENTS) THAT MAY ARISE FROM INJURIES, HARM OR LOSS RESULTING FROM PARTICIPATION IN THE SCAVENGER HUNT.
3. Waiver of Right to Sue. Each participant or his/her/their parent or guardian, on behalf of such participant and its successors, assignees, heirs, distributees, guardians, beneficiaries, and legal representatives hereby forever waive, release, and discharge SFCTA and its officers, directors, employees, representatives, and agents, together with their successors, assigns, controlling parties, subsidiaries, and affiliates (collectively, “Released Parties”) from any and all past, present, and future actions, claims, demands, damages, and costs (including without limitation attorneys’ fees and medical bills), known and unknown, including without limitation any claims based on any actual or alleged negligence of any Released Parties or based on my death, disability, personal injury, or property damage (collectively, “Claims”), arising from or related in any way to participation in, involvement with, or presence at, the Scavenger Hunt. Without limiting the foregoing, I further agree that neither I nor any Releasing Parties shall (or shall have the right to) sue, take any legal action, or make any Claims against any of the Released Parties or any of their property as a result of my participation in the Scavenger Hunt, and that to the maximum extent permitted by law, in no event will SFCTA be liable for any actual, consequential, special, or indirect damages.
